All defined terms used below have the meanings set forth in the Culturyst Terms of Service.

This Privacy Policy (“Policy”) explains how information about you is collected, used, and disclosed by your access or use of our Service or otherwise as a result of your interactions with us. By accessing the Service directly or through another site, you accept the terms and conditions of this Policy. This Policy applies to our website at www.culturyst.com and any related services provided by us. We are not responsible for the content or privacy practices on any website not operated by us to which our Service links or that links to our Service. If you do not agree with the terms of the Policy, please do not use or access our Service.

INFORMATION COLLECTION
We collect information from you in several different ways on the Site.

Registration and Ordering: Before using certain portions of our Service, you may be required to complete an online registration form. During registration, you will be asked to provide to us certain personal information, including but not limited to your name, phone number, email address, and credit card number. These kinds of personal information are used for billing purposes, to fulfill your order, to communicate with you about your order and our Service, and for internal marketing purposes.

Communications: If you contact us directly, we will receive additional information about you. For example, when you contact our customer support, we may receive your name, email address, phone number, the contents of any message or attachments that you send to us, and other information you choose to provide.

For example, we may collect information from third party social media platforms (such as Facebook or Instagram) if you make certain content and information such as photos, videos, and profile information, publicly available. Information posted on other sources is subject to that respective source’s privacy policy.

USE OF INFORMATION

Internal Use
We use the information we collect from or about you to:

  • Provide, improve, expand, personalize, and promote the Service;

  • Understand and analyze how you use the Service;

  • Develop new products, services, features, and functionality;

  • Send you email, text messages, push notifications or other communications;

  • Facilitate transactions and payments;

  • Find and prevent fraud; and

  • For compliance purposes, including enforcing the Culturyst Terms of Service or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency.

Cookies
We and third party partners collect information using cookies, pixel tags, or similar technologies. Our third party partners, such as web hosting, analytics and advertising partners, may use these technologies to collect information about your online activities over time and across different online services. Cookies are small text files containing a string of alphanumeric characters. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Service. Please review your web browser “Help” file to learn the proper way to modify your cookie settings. Please note that if you delete, or choose not to accept, cookies from the Service, you may not be able to utilize the features of the Service to their fullest potential.

Communications with You
We will use your information to communicate with you about the Service and your orders, to provide customer support, and to provide you with updates or information relating to our Services, including promotions and other opportunities. Also, we may send you a confirmation email and text message when you register with us. We may send you a service-related announcement on the rare occasions when it is necessary (for example, if we must temporarily suspend the Service for maintenance). Also, we may send you a confirmation email and text message when you register with us or otherwise sign up to receive our email newsletters, special offers, and other marketing communications. If you submit your email address, we use it to deliver the information to you. We always permit you to unsubscribe or opt out of future promotional emails. Because we have to communicate with you about orders that you choose to place, you cannot opt out of receiving emails related to your orders.

DISCLOSURE
Your privacy is important to us, and we are not in the business of selling customer information to others. We share customer personal information only as described below.

Business Partners: In order to provide our Services, we work with various business partners who provide the events, including venues, event organizers, promoters and/or their affiliated agents. They have access to personal information needed to perform their functions, but may not use it for other purposes.

Third-Party Service Providers: We may use other companies and individuals to perform functions on our behalf, including processing credit card payments, website hosting, sending postal mail and e-mail, analyzing data, providing technical support, and providing marketing assistance. They have access to personal information needed to perform their functions, but may not use it for other purposes.

In order to process your credit and debit card payments, we must provide your card number to financial-services corporations such as credit-card processors and issuers as is required to process your orders. We use a third-party payment processor, Stripe, to process payments made to us. In connection with the processing of such payments, we do not retain any financial information such as credit card numbers. Rather, all such information is provided directly to Stripe, whose use of your personal information is governed by their privacy policy, which may be viewed at https://stripe.com/privacy.

Protection of Culturyst and Others: We may disclose your information, including personal information or financial information, in response to requests from law enforcement officials conducting investigations; subpoenas; a court order; or if we are otherwise required to disclose such information by law. We also will release personal information where disclosure is necessary to protect our legal rights, enforce our Terms of Service or other agreements, or to protect ourselves or others. For example, we may share information to reduce the risk of fraud or if someone uses or attempts to use the Service for illegal reasons or to commit fraud.

Business Transfers: While we will not sell personally identifiable information to other companies as part of our regular course of business, if we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy or liquidation, receivership, sale of our assets, or transition of the Service to another provider, then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract. The use of your information following any of these events will be governed by the provisions of this Privacy Policy in effect at the time the applicable information was collected.

With Your Consent: We may also disclose your information with your permission.

DATA SECURITY
We take commercially accepted security measures, including administrative, technical, and physical safeguards, to protect information about you from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. However, no data transmission over the internet can be guaranteed to be 100% secure. As a result, while we strive to protect your submitted information, we cannot guarantee or warrant the security of any information you transmit to the Service, and you do so at your own risk. We will not be responsible for any damages directly or indirectly caused by an unauthorized third party’s ability to view, use or disseminate personally identifiable information.

We urge you to keep your password in a safe place and not to divulge it to anyone. Remember to log off your account and exit our application when you have finished using the Service. This is to help ensure that others cannot access your account.

OPT OUT/CORRECTIONS
Upon your request, we will (a) correct or update your personal information; (b) stop sending promotional emails to your email address; and/or (c) disable your account to prevent any future purchases through that account. You can make these requests by emailing us at help@culturyst.com. You can also unsubscribe from promotional emails by clicking the “unsubscribe” button included in such emails.

Please do not email your credit-card number or other sensitive information.

CHILDREN’S PRIVACY
We respect children’s privacy. We do not knowingly collect, maintain, or use personal information from children under 18 years of age, and no part of the Service is directed to children. If you learn that a child has provided us with personal information in violation of this Policy, then you may alert us at help@culturyst.com.

OFFLINE COLLECTION USE AND DISCLOSURE
We also may collect information offline. We will treat any information collected offline in a manner that is consistent with this Policy. One example involves someone calling us to place an order or to ask questions. When someone calls, we will ask only for the personal information we need in order to place the order or to answer the question. When we need to store information (such as order information), we will enter it into our database.

TERMS OF SERVICE, UPDATES TO THIS POLICY
If you choose to use the Service, your visit and any dispute over privacy is subject to this Policy and our Terms of Service, including limitations on damages, resolution of disputes, and application of the law of the state of Washington. If we change or update this Policy, we will post changes and updates on the Service so that you will always be aware of what information we collect, use and disclose. We encourage you to review this Policy from time to time so you will know if the Privacy Policy has been changed or updated.
